These Terms and Conditions apply to all those who access this website (the "Site"). Please read them carefully before using the Site. We reserve the right to periodically modify the Terms and Conditions at our own discretion. It is recommended to read the Terms and Conditions periodically in order to check for any updates and to keep a copy of them for future reference.

The Site is available for your use only on the condition that you accept and agree to the Terms and Conditions and our Privacy Policy as set forth below. In case you do not agree to any changes that have been made to the Terms and Conditions, you must immediately stop using the Site.

2. Services Provided

Plamex 8 LTD ("we", "us") makes its website ("Site") and related services available to you in accordance with the following Terms and Conditions and any other rules posted on our Site.

These Terms and Conditions regulate the use of the online store support@plamexs.com, as well as provide you with information related to the conclusion of distance contracts through the online store between Plamex 8 LTD and the Users.

The purpose of the online store is to make distance sales of second-hand goods: clothes, bags, hats, scarves, purses, etc., which are not purchased directly from the manufacturer or its distributors and have already been purchased and/or used by other users.

3. Registration and Account Terms

The Site allows Users to view and order the goods offered free of charge, without the need for registration.

In order to access all the functionalities of the Site — such as ordering goods, creating a list of favorite products, accessing information about personal data, viewing order history, etc. — Users must create an account using their email address and password. Opening an account is free of charge and there is no obligation to buy anything on the Site. Users must be over 18 years of age.

An account is registered after filling in a registration form indicating valid data required for the delivery of the ordered goods. Fields marked with a star are required. In case of change in the data, the User undertakes to update them in a timely manner.

By filling in the data and pressing the "Register" or "Continue with Facebook" button, the User declares that he/she is familiar with these general terms, agrees with their content, and undertakes to comply with them unconditionally. It is considered that the User is familiar with these general terms and conditions and accepts them if he/she has proceeded to an order without registration or through the "Quick order" procedure.

Upon successful completion of the registration, the User receives an email confirming the successful registration. If you do not receive such confirmation, you can notify us by email at support@plamexs.com or by phone at +359 893 711 756. After successful registration, an account will be created between the User and Plamex 8 LTD, and both parties will be liable for the contractual relations.

Once registered, Users shall be able to access and use their accounts using their email address and password. These identifiers must never be disclosed to any third party, nor must any third party be permitted to use them.

Users undertake not to create or use any accounts other than the account they shall have created initially, be it under their own identity or that of a third party. Users undertake not to choose a user name that provides a means of identifying an e-commerce website other than the Site. Should any User fail to comply with these prohibitions, Plamex 8 LTD shall be entitled to close that User's account immediately.

Users undertake to inform Plamex 8 LTD via the FAQ contact form available at support@plamexs.com about any fraudulent use of their user name, identifier, and/or password by a third party, as soon as they become aware of this. Users undertake to compensate Plamex 8 LTD should the latter suffer any damage, loss, or incur any costs as a result of any other person accessing information in a User's account, if the User involved authorised this use or was aware of it.

4. Age of Consent

Access is made available only to those who accept the terms and conditions of the following agreement.

Under perjury of law I solemnly affirm that I am 18 years or over (or the minimum age set out by the laws in my community) and have the legal right to view the content of this Site (https://plamexs.com/) or to register as a User. If we discover or have reason to suspect that you are not over 18 years of age, we reserve our right to suspend or terminate your Membership to this Site immediately and without notice.

I understand the laws and standards set out in my community, site, and computer to which I am transporting this material, and I am solely responsible for my own actions. I am not accessing https://plamexs.com/ for the purpose of obtaining information that will be used by me or others in any capacity against the webmaster of this site, host of this site, its owners, employees, or any other parties associated with the Site.

By continuing past the home page of this Site, I will have released and discharged the providers, owners, and creators of this Site from any and all liability which might arise. I am not a law enforcement agent, nor do I work with criminal law. If I use the services in violation of the above and below agreement, I understand I may be in violation of local and federal laws and solely responsible for my own actions.

I understand that bookmarking to a page on this server/site whereby this warning page is bypassed shall constitute an implicit acceptance of the foregoing terms herein set forth. Reproduction of this Site is strictly prohibited; this includes pictures, design, and all text.

5. Goods and Orders

The goods we offer are second-hand with excellent quality, authentic, and fully meet the requirements of Bulgarian and EU legislation for trade in used clothes. The profile of each product describes the price and its characteristics such as colour, condition, brand, size, and composition (when known). Plamex 8 LTD is not responsible for discrepancies in the colours of products that depend on the settings of the User's device.

The photos you see on the Site are of the real product you will receive when ordering. Users can purchase all goods offered on the Site by electronic order. In case of a technical error on the Site (regarding price, product availability, etc.), we reserve the right to refuse an order, and must notify the User by phone or email, but we do not owe compensation of any kind.

The use of https://plamexs.com/ for electronic ordering of goods has the force of a distance sales contract. The User should enter the password selected by him and the remote access password, or switch to an order without registration through the "Quick order" procedure. The username and the remote access policy are determined by the User through online registration on the website.

How to Place an Order

  1. Items the User intends to buy should be added to the "Cart" by selecting the desired product and pressing the ADD TO Cart button, located to the right of the product photo.
  2. To view the items added to the Cart, press the "VIEW THE CART" button, located in the upper right corner.
  3. Enter your shopping cart, apply the PROMO CODE if you have received one, select the delivery method, and press "NEXT".
  4. Then press the "ORDER" button, located in the lower right corner.
  5. If you are a registered user, a form will open in several steps where you must confirm the delivery address, select the type of delivery, check the box confirming that you have read and accept the Terms and Conditions, and finally press the "ORDER" button.

The order automatically describes the type and quantity of the ordered goods, the exact final price (including VAT), the price of the delivery according to the content of the User's Cart, payment methods, warranty information, and how the User can withdraw from the contract.

The contract is considered concluded after clicking the "ORDER" button and receiving an email to confirm the order. Pursuant to this contract, the company undertakes to deliver and transfer ownership of the goods specified by the customer, in accordance with the terms of these General Terms and Conditions and at the place specified in the consumer's order.

The User and the company agree that all statements between them in connection with the conclusion and execution of the contract of sale may be made electronically within the meaning of the Electronic Commerce Act.

In the absence of stock of a product, Plamex 8 LTD reserves the right to fulfil the order with the remaining goods available or to refuse the entire order. For this purpose, Plamex 8 LTD is obliged to notify the User in advance and act in accordance with the User's decision.

6. Wholesale / B2B Sales

Plamex 8 LTD also offers wholesale access ("B2B") to registered companies holding a valid EU VAT number.

  • Wholesale orders are available only to approved business partners after a verification process conducted by Plamex 8 LTD via the official VIES VAT validation system.
  • All wholesale sales are strictly Business-to-Business and are therefore excluded from consumer protection rights that apply to private individuals (such as the right of withdrawal under Directive 2011/83/EU).
  • Wholesale prices are provided exclusive of VAT. VAT will be applied or reverse-charged according to EU law, depending on the buyer's VAT registration and location.
  • Returns, exchanges, or cancellations are not accepted for wholesale orders, except in the event of a shipping error or a proven discrepancy in the item's description or condition.
  • Plamex 8 LTD reserves the right to refuse or revoke wholesale access at any time if the buyer's VAT number cannot be validated, or if resale practices conflict with Plamex's standards and partner agreements.

Information provided through the wholesale application form — including company name, VAT number, and business contact details — is collected solely to evaluate wholesale eligibility and will not be shared with third parties.

7. Prices

From the online store, by electronic order, you can buy only goods that can be added to the shopping cart.

All prices announced on the Site are in Euros including VAT, with all legal fees (if any), and do not include delivery costs, which will be added to the total amount due. Delivery costs vary according to the chosen delivery method. The total amount due will be announced before pressing the "NEXT" button.

The price of all goods is announced in the profile of the respective product. Promotional items have a new and old price, with the old one presented as struck-through. From the moment of ordering to the moment of payment, the prices are not subject to change.

The merchant reserves the right to change the prices announced on the Site without prior notification to Users.

8. Payments and Payment Methods

Plamex 8 LTD provides the following payment options:

  • Virtual POS Terminal for card payments — B Card, Maestro, Mastercard, Visa, Visa Electron, Trans.card, Diners Club, Discover, Union Pay.
  • Payment with saved card: This option allows you to save your card data to save time on future purchases. You can enter data for more than one of your debit or credit cards. The "Pay with 1 click" method can be activated at any time after creating your account, when registering a new card-paid order.

Payment is accepted only in Euros. Delivery is made to the customer's address according to the request. The amount of the delivery depends on the weight of the shipment.

If you want an invoice to be issued for the goods, the customer must explicitly indicate this in the notes to the order or contact us by phone.

By accepting these general terms and conditions, the User agrees to pay the price of the ordered items, plus the price of delivery, to the courier upon receipt of the goods.

In case of refusal by the customer to take the goods after inspection, the customer must pay the cost of delivery for the return of the goods to Plamex 8 LTD. The costs of returning a refused order are at the expense of the User.

Payment is made by the User handing over to the courier the amount equal to the total amount due (the price of the ordered goods plus the delivery price). The courier notes this in the handover coupon, which serves as a receipt and certifies the delivery of the goods.

By signing this coupon, the customer agrees to the courier handing over, on his behalf and at his expense, the amount specified as the selling price of the delivered order to Plamex 8 LTD.

9. Withdrawal from the Contract and Replacement

Each User can exercise his right to withdraw from the contract before his order is delivered to a courier by calling or writing to the contact forms listed on the Site (phone or email), but only in cases where the order is cash on delivery and has not been delivered by courier.

Plamex 8 LTD reserves the right not to cancel orders in cases where they are paid online at the time of the order or are in the status "By courier", regardless of the method of payment.

Return Policy

Each User has the right to return the products within 30 working days from the date of delivery.

Before returning the product:

  1. Contact an employee of the Site by phone: +359 893 711 756
  2. Fill out a return form and send it to: support@plamexs.com, specifying the reasons and method of return.
  3. In order to return the item, the customer must not have treated the products in any way (laundry, ironing, corrections, etc.).

In case of non-compliance, the return of products and the request for a complaint will not be considered.

Return Conditions

  • Return address: 9000 Varna, Str. Koevo 3
  • Refunds are issued by bank transfer, card, or PayPal to the account specified by the customer.
  • Return shipping costs are borne by the customer and must be carried out via DHL Express.
  • Cash on delivery is not accepted for returns.

In case of complaint and return, the value of the sent products is refunded within 30 days from the date the User exercises this right.

After accepting the returned products and establishing compliance with the sent items, we will contact you to confirm receipt of the shipment. The amount will be refunded to the card the User used to order, within 30 days.

In case of a wrong order from the customer or a wish to cancel the order before it is sent, he has the right to specify this with Plamex 8 LTD by phone: +359 893 711 756 or email: support@plamexs.com. In this case, the customer does not owe any fees or penalties.

10. Delivery

The delivery of the ordered goods is carried out by courier to the office or address for delivery on the territory of the EU, as specified by the User. Delivery is at the expense of the User, unless otherwise stated at https://plamexs.com/.

Before sending the ordered goods, Plamex 8 LTD has the right to contact the User on the phone number specified by him to clarify the details of the order and/or delivery.

Plamex 8 LTD is not responsible for non-fulfilment of an order in cases where the User has provided incorrect, incomplete, and/or inaccurate personal data — including incomplete, inaccurate, or fictitious address or telephone number.

Delivery takes place within the timeframes described under each delivery option in the order interface module. In exceptional circumstances, Plamex 8 LTD reserves the right to extend the delivery period by promptly informing the consumer.

The consumer is obliged to inspect the goods at the time of delivery and to notify us immediately of any discrepancies, shortages, or damages. If the User does not do so, it is assumed that the delivery is accepted without objection.

11. Termination of the Contract

The contract is terminated in cases where:

  • The User has provided inaccurate data, is not at the specified address, and does not answer the specified contact phone number in order to negotiate with the courier service;
  • The User does not pay the specified amount due;
  • Plamex 8 LTD declares liquidation;
  • One of the parties declares bankruptcy;
  • By written mutual agreement from both sides;
  • In case of objective impossibility of any party to perform their obligations under the contract;
  • In case of cancellation of the User's registration on the Site of Plamex 8 LTD. In this case, the concluded but not executed contracts for purchase and sale remain in force and are subject to execution.

Plamex 8 LTD reserves the right unilaterally to terminate the contract without further notice if it finds that the services provided are used in violation of these general terms and conditions, the legislation of the Republic of Bulgaria and the EU, or generally accepted moral norms.

Repeated Cancellations / Refusals

Plamex 8 LTD reserves the right to terminate a contract of sale with a User who has, on three (3) consecutive occasions, not taken and/or not accepted deliveries made by cash on delivery to addresses specified by him — whether personal address or office address of the courier company. The cancellation of the agreement is executed by cancelling each subsequent cash-on-delivery order placed by the same User.

A User who systematically refuses, cancels orders, or does not pick up the ordered goods from the courier's office and/or does not accept orders at the address indicated by him may be temporarily or permanently restricted by Plamex 8 LTD from the possibility of ordering cash-on-delivery orders.

"Systematically" shall be perceived as three or more cancelled/refused orders and/or unreceived orders from the courier office, and/or unaccepted orders at the User's own address — whether consecutive or not, and regardless of the frequency and value of each.

Plamex 8 LTD also has the above rights with respect to a User who has orders with a delivery address or telephone number that partially or completely matches the delivery address or telephone number of another User who systematically cancels/rejects orders in the manner described in these Terms and Conditions.

12. Responsibility and Warranty

It is up to the Users to ensure that all their acts and all User content that they put online on the Site comply with the legislation applicable to them.

Except as otherwise set forth on this Site — including, without limitation, the product descriptions of specific products — this Site, the products offered for sale, and the transactions conducted through it are provided by us on an "as is" basis. We make no representation or warranty of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on this Site.

To the full extent possible by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Plamex 8 LTD hereby disclaims liability for any damage or loss arising from any activity performed by the User on the Site, including but not limited to:

  • Any loss of data
  • Any loss of a sale or purchase opportunity
  • Any loss of earnings, turnover, or business activity
  • Any loss of opportunities or clients
  • Any damage to the User's reputation or interruptions of their activity
  • Any indirect loss or damage incurred by the User
  • Any impediment or delay in the performance of obligations caused by any act or omission on the part of a User (or any person acting on the User's behalf) or arising from force majeure

Plamex 8 LTD does not provide any warranty against losses or damage that may be caused by the transmission of a computer virus, worm, time bomb, Trojan horse, cancelbot, malware, or any other program designed to damage, destroy, or degrade the functionality of a computer, or to impede its proper operation. This includes any transmission arising from the downloading of any content by a User, any software applications used to download the content of the Site, or any access to the server.

In this respect, Users acknowledge that it is their responsibility to install anti-virus software and appropriate security applications on their computer equipment and on any other system in order to protect them against any bug, virus, or other malicious program.

13. Jurisdiction

The provisions of the current legislation of the Republic of Bulgaria and the EU shall apply to issues not specified in these general terms and conditions.

These Terms and Conditions shall be construed in accordance with the laws of the Republic of Bulgaria and the EU, without regard to any conflict of law provisions.

If one of the provisions of these Terms and Conditions is waived, this shall not be considered a waiver of any other provision or of our right to require strict observance of each of the terms herein. In case a provision of these Terms and Conditions is found unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect.

 

 

Affiliate Program

Plamex 8 LTD ("we", "us", "Plamex 8 LTD") operates an affiliate marketing program (the "Program") through which independent third parties ("Affiliates") may promote products available on the Site and earn a commission on resulting sales, subject to these Terms and Conditions. The Program is technically administered through a third-party platform (currently UpPromote).

Nature of the Relationship

Participation in the Program does not create any partnership, joint venture, agency, franchise, employment, or business-user relationship between the Affiliate and Plamex 8 LTD. Affiliates act solely as independent, self-employed marketing contributors. Affiliates have no authority to bind Plamex 8 LTD to any obligation, to make representations on its behalf, or to act as its agent in any respect. Plamex 8 LTD remains the sole seller of record for all products purchased through the Site, regardless of how the customer was referred.

Eligibility and Approval

Participation in the Program is offered at the sole discretion of Plamex 8 LTD. We reserve the right to accept, reject, suspend, or remove any applicant or Affiliate at any time, with or without cause or prior notice, and without any obligation to provide a reason or compensation. Affiliates must be at least 18 years of age.

Commissions Are Not a Right — Conditional and Discretionary

Commissions are not earned, vested, or owed simply because a click, lead, or transaction is recorded by the tracking platform. A commission becomes payable only once the underlying order has been fully completed, paid for, delivered, and is no longer subject to cancellation, return, refusal, chargeback, or refund under Section 9 of these Terms and Conditions, and only after Plamex 8 LTD has reviewed and approved the transaction as genuine and compliant with these Terms.

Plamex 8 LTD reserves the right to withhold, adjust, reverse, or refuse to pay any commission that it determines, in its sole discretion, to have resulted from a cancelled, refunded, fraudulent, erroneous, duplicate, self-referred, or otherwise non-qualifying transaction, or from any violation of the Prohibited Practices listed below.

In particular, if a customer cancels, returns, or refuses an order — in whole or in part — at any point within the 30-day period referenced in Section 9 of these Terms and Conditions (Withdrawal from the Contract and Replacement), no commission shall be due or payable on that order, regardless of whether the commission was previously marked as pending or approved within the Program platform. Any commission already paid out in connection with such an order shall be deducted from the Affiliate's future earnings.

The standard commission rate is 10% of the net sale value (excluding VAT, delivery costs, and any subsequently refunded amounts) for qualifying purchases made within a 30-day cookie attribution window following the customer's click on the Affiliate's unique tracking link. Commissions are paid via PayPal or bank transfer, subject to the minimum payout threshold set out within the Affiliate's dashboard on the Program platform.

Plamex 8 LTD reserves the right to change the commission rate, the cookie attribution window, minimum payout thresholds, and payment schedules at any time, applicable to future tracked activity, by updating the Affiliate's dashboard or providing reasonable notice. Continued participation in the Program after such a change constitutes acceptance of the updated terms.

Prohibited Practices

Affiliates must not, under any circumstances:

  • bid on, purchase, register, or otherwise use "Plamexs," "Plamex 8 LTD," or any confusingly similar, misspelled, or derivative term as a keyword, domain name, or brand term in any paid search, social media, or display advertising campaign;
  • engage in spamming, unsolicited bulk messaging, or any false, misleading, or deceptive advertising, claim, discount, or representation in connection with the Site or its products;
  • generate or attempt to generate clicks, leads, or sales through automated means, bots, incentivized clicking, cookie stuffing, forced redirects, malware, browser extensions that auto-insert affiliate links, or any other artificial or fraudulent method;
  • use the Plamexs name, trademarks, logos, or product images in a manner that is misleading, defamatory, or that suggests an affiliation, sponsorship, partnership, or endorsement beyond participation in the Program;
  • promote the Site through content that is unlawful, infringing, offensive, or otherwise damaging to the reputation of Plamex 8 LTD, as determined in its sole discretion.

Any violation of the above entitles Plamex 8 LTD to immediately suspend or terminate the Affiliate's account, void any pending or already-approved commissions related to the violation, and pursue any other remedy available under applicable law.

Tracking and Data

The Program relies on cookies and similar tracking technologies, operated through the Program platform, to attribute sales to the referring Affiliate. By making a purchase through an Affiliate's link, Users acknowledge that such tracking technologies may be used in connection with that order.

Termination

Plamex 8 LTD may suspend or terminate any Affiliate's participation in the Program, or the Program itself, at any time, for any reason or no reason, with or without prior notice. Upon termination, no further commissions shall accrue, and any commission tied to a transaction not yet fully approved and paid out as described above shall not be due.

Limitation of Liability

To the fullest extent permitted by applicable law, Plamex 8 LTD shall not be liable to any Affiliate for any indirect, incidental, or consequential loss, including loss of anticipated earnings, arising from participation in the Program, its suspension, modification, or termination, or from any technical failure, delay, or inaccuracy of the tracking platform.
